BOATING ACCIDENTS
The operator of a vessel involved in a recreational boating accident must submit a casualty or accident report to the reporting authority in the State where the accident occurred when:
- A person dies;
- A person is injured and requires medical treatment beyond first aid;
- Damage to the vessel and other property totals more than $1,000.00 or a complete loss of the vessel; or
- A person disappears from the vessel under circumstances that indicate death or injury.
Accidents; reports
Whenever any vessel, including rowboats and canoes, meets with an accident involving a loss of life, personal injury or damage to property and the operator thereof has knowledge of such accident, he shall stop and give his name and address, the name and address of the owner thereof and the identification number, if any, assigned to said vessel to the injured person or the person sustaining the damage. In the event the person injured or damaged cannot be located at the place where the accident occurred, then said information and a description of the accident shall be reported by the operator of the vessel within twenty-four hours to the nearest police or local judicial officer.
Every person operating a vessel, including rowboats and canoes, upon the navigable waters of the state, or on any other waters within the boundaries of the state, which is in any manner involved in an accident, in which any person is killed, injured or disappears, shall immediately notify the nearest law enforcement agency, and within forty-eight hours after such accident report the matter in writing to the commissioner. If such operator is physically incapable of making such report and there is another participant in the accident not incapacitated, such participant shall make the report within forty-eight hours after such accident.
Every person operating a vessel, including rowboats and canoes, upon the navigable waters of the state, or on any other waters within the boundaries of the state, which is in any manner involved in an accident, in which only damage to the property of any person including, property of such operator, in excess of one thousand dollars is sustained, shall within five days after such accident, report the matter in writing to the commissioner. If the owner is not involved in such accident or incapacitated, the owner shall, within five days after learning of the facts of such accident, report the matter to the commissioner together with such information as may have come to the owner`s knowledge relating to such accident.
Negligence in use or operation of vessel attributable to owner
Every owner of a vessel used or operated upon the navigable waters of the state or any tidewaters bordering on or lying within the boundaries of Nassau and Suffolk counties, shall be liable and responsible for death or injuries to person or property resulting from negligence in the use or operation of such vessel, in the business of such owner, or otherwise, by any person using or operating the same with the permission, express or implied, of such owner.
